1. THE PROMOTER
The promoter is: Airbus Defence and Space Limited of Gunnels Wood Road, Stevenage, Hertfordshire, SG1 2AS United Kingdom ("the Promoter").
2. THE COMPETITION
2.1 The title of the competition is the A400M Photography Competition.
2.2 The competition is for eligible individuals (see clause 4) who have captured a great photograph of the A400M aircraft.
3. HOW TO ENTER
3.1 The competition will run from 19th June 2017 (the "Opening Date") to 24th November 2017 (the "Closing Date") inclusive.
3.2 All competition entries must be received by the Promoter by no later than 11.59pm on the Closing Date. All competition entries received after the Closing Date are automatically disqualified.
3.3 You can enter the competition online by uploading your images on the competition microsite www.a400m-photocompetition.com.
3.5 The Promoter will not accept:
(a) responsibility for competition entries that are lost, mislaid, damaged or delayed in transit, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
(b) proof of submission or transmission as proof of receipt of entry to the competition.
3.6 By submitting a competition entry, you are agreeing to be bound by these terms and conditions.

3.9 The Military and General Public category entries will be judged by a panel of five judges. The decision of the panel of judges (acting reasonably) will be final. For the Young Persons category, the panel of 5 judges will select 5 finalist photographs which will be uploaded onto the Airbus Twitter account (https://twitter.com/airbusdefence) and the winner will be the photograph with the most retweets.
3.10 A list of names of the judges can be viewed on www.a400m-photocompetition.com from the Closing Date for a period of 30 days.
4.1 The competition is open to the following in each category:
Military – aged 18 years or over and currently serving in the UK armed forces;
General Public - aged 18 years or over;
Young Person’s Award – aged between 16 years and 21 years
(a) employees of the Promoter or any Airbus company or its affiliates;
(b) members of the immediate families or households of (a) above;
(c) anyone who holds a passport or is a national or dual nation of any sanctioned countries.
4.2 In entering the competition, you confirm that:
(a) you are eligible to do so for the category that you are entering and eligible to claim the prize. The Promoter may require you to provide proof that you are eligible to enter the competition;
(b) you are willing to undertake any security vetting procedures that may be required for access to the relevant Airbus site;
(c) the photograph that you submit was taken by you and not by a third party;
(d) by uploading the photograph you own the copyright in such photograph.
4.3 The Promoter will not accept competition entries that:
(a) are automatically generated by computer;
(b) are illegible, have been altered, reconstructed, forged or tampered with;
(c) are incomplete;
(d) include photographs taken by someone other than you.
4.4 There is a limit of three entries per person (not 3 entries per category). The first 3 photographs uploaded to www.a400m-photocompetition.com will be counted for the purposes of the 3 entries per person. Entries on behalf of another person will not be accepted and joint submissions are not allowed.
4.5 The Promoter reserves all rights to disqualify you if your conduct is contrary to the spirit or intention of the competition.
4.6 Competition entries cannot be returned.
5. THE PRIZE
5.1 Military and General Public Categories - The prizes are a trip for one person per category to the Airbus A400M manufacturing site in Seville (the "Site") which will include a guided tour of the A400M Final Assembly Line, the International Training Center and the opportunity to participate in a supervised Full Flight Simulator (FFS) experience. The prize includes flights to Seville (see clause 5.4), 1 night’s accommodation in a hotel of the Promoter’s choice and transfers to and from the Airport and the Airbus site. For the avoidance of doubt there is one prize per category available to be won.
5.2 Young Person’s Award - The prize is a trip for one person plus one accompanying person to the Airbus A400M manufacturing site in Seville (the "Site") which will include a guided tour of the A400M Final Assembly Line and the International Training Center. The opportunity to participate in a supervised Full Flight Simulator (FFS) experience will be only for the winner of the Young Person’s Award (not for the person accompanying him/her). The prize includes flights to Seville (see clause 5.4) for both the winner of the Young Person’s Award and the accompanying person, 1 night’s accommodation in a hotel of the Promoter’s choice and transfers to and from the Airport and the Airbus site.
5.3 The prize is provided by Airbus Defence and Space SAU.
5.4 The prize is for one person (plus an accompanying person in the case of the Young Person’s Award) to travel by economy class to Seville for one night between 1st February 2018 and 1st December 2018. The Promoter will contact all three winners to arrange a mutually agreed date for all three winners (plus an accompanying person in the case of the Young Person’s Award) to travel to the Site. The prize does not include travel insurance, passport or visa costs, food and drink, spending money, tax or personal expenses. Any other costs incurred in addition to those set out above and that are incidental to the fulfilment of the prize are the responsibility of the winner(s).
5.5 You will be responsible for ensuring that you and any person travelling with you are available to travel and hold valid passports, any necessary visas and travel documents for the prize in question on the travel dates specified.
5.6 There is no cash alternative for the prize.
5.7 The prize is supplied by Airbus Defence and Space SAU. The Promoter reserves the right to replace the prize with an alternative prize of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so.
5.8 The prize is not negotiable or transferable.
6. WINNER ANNOUNCEMENT
6.1 The winner of each category of the competition will be announced on www.a400m-photocompetition.com on 11th December 2017 with accompanying press releases and social media releases (the "Announcement Date").
6.2 The decision of the judges nominated by the Promoter is final and no correspondence or discussion will be entered into.
6.3 The Promoter will contact the winners personally as soon as practicable after the Announcement Date, using the telephone number or email address provided with the competition entry. The Promoter will not amend any contact information once the competition entry form has been submitted.
6.4 A list of winners can be viewed on www.a400m-photocompetition.com from the Announcement Date for a period of 30 days.
7. CLAIMING THE PRIZE
7.1 The prize may not be claimed by a third party on your behalf.
7.2 The Promoter will make all reasonable efforts to contact the winner. If the winner cannot be contacted or is not available, the Promoter reserves the right to offer the prize to the next eligible entrant selected by the judges from the entries that were received before the Closing Date.
7.3 The Promoter does not accept any responsibility if you are not able to take up the prize.
8. LIMITATION OF LIABILITY
Insofar as is permitted by law, the Promoter and its agents will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the prize except where it is caused by the negligence of the Promoter, or its agents or that of their employees.
9. OWNERSHIP OF COMPETITION ENTRIES AND INTELLECTUAL PROPERTY RIGHTS
9.1 All competition entries and any accompanying material submitted to the Promoter will become the property of the Promoter on receipt and will not be returned.
9.2 By submitting your competition entry and photograph, you agree to:
(a) assign to the Promoter all your intellectual property rights with full title guarantee; and
(b) waive all moral rights,
in and to your competition entry and photograph and otherwise arising in connection with your entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.
9.3 You agree that the Promoter may, but is not required to, make your entry available on its website(s) and any other media, whether now known or invented in the future, and in connection with any publicity of the competition. You agree to grant the Promoter a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry and the photograph, to use, display, publish, transmit, copy, edit, alter, store, re-format and sub-licence the competition entry and the photograph for such purposes.
10. DATA PROTECTION AND PUBLICITY
10.1 If you are the winner of the competition, you agree that the Promoter may use your name, image and country of residence to announce the winner of this competition and for any other reasonable and related promotional purposes.
10.2 You further agree to participate in any reasonable publicity required by the Promoter.
10.3 By entering the competition, you agree that any personal information provided by you with the competition entry may be held and used only by the Promoter its affiliated companies or its agents to administer the competition.
11.1 If there is any reason to believe that there has been a breach of these terms and conditions, the Promoter may, at its sole discretion, reserve the right to exclude you from participating in the competition.
11.2 The Promoter reserves the right to hold void, suspend, cancel, or amend the prize competition where it becomes necessary to do so.
11.3 These terms and conditions shall be governed by English law, and the parties submit to the exclusive jurisdiction of the courts of England and Wales.
